Article 1: Fair Usage and Spam Policy

Deploy Email operates under a Fair Usage Policy to prevent potential abuse. Excessive or improper use of our Services, such as spamming, may result in restrictions or termination of your account without refund.

1.2 Spam Definition

"Spam" refers to unsolicited email communications that result in the recipient reporting the email as spam to their provider, being listed on a blacklist, or mass sending of emails that exceed accepted cold email standards. This includes, but is not limited to, violations of the CAN-SPAM Act in the United States and the GDPR and ePrivacy Directive in the European Union.

Article 2: Data Access and Privacy

2.1 Data Ownership

While you retain ownership of your data, Deploy Email may anonymize and randomize data to extract information and improve our Services.

2.2 Privacy and Access

Deploy Email reserves the right to access and review your data at any time without notice, primarily to improve our Services and enhance email deliverability.

Article 3: Prohibited Uses

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service for:

  • Spamming: Sending emails that violate the CAN-SPAM Act, GDPR, or any other applicable anti-spam regulations.

  • Phishing: Sending fraudulent emails that attempt to steal information.

  • Malicious Content: Distributing content containing malware, viruses, or other harmful code.

  • Harassment: Using our email service to harass, intimidate, or threaten any individual or group.

  • Illegal Activities: Engaging in any illegal activities using our email service.

  • Prohibited Industries: Using our service for crypto, political activities, or any industry not compliant with the Anti-Spam Act or GDPR.

Additionally, you agree not to:

  • Use the Service in any manner that could disable, overburden, damage, or impair the Service or interfere with any other party’s use of the Service.

  • Introduce any viruses, trojan horses, worms, logic bombs, or other malicious or technologically harmful material.

  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.

  • Attack the Service via a denial-of-service attack or a distributed denial-of-service attack.

Article 4: Warranties and Limitations on Deliverability

Deploy Email strives to ensure high deliverability rates for your emails. However, many factors outside our control, such as recipient server issues, spam filters, and third-party network problems, can impact deliverability. We do not guarantee perfect deliverability and cannot be held responsible for any damages resulting from failed or delayed deliveries.

4.2 No Refunds

Due to the multifaceted nature of email deliverability, Deploy Email does not offer refunds for poor deliverability or for any issues that arise from factors outside our direct control.

Article 5: Termination

5.1 Right to Terminate

Deploy Email reserves the right to terminate your account if you violate these Terms, including the Fair Usage Policy. Upon termination, all amounts owed by you become due immediately. Access to your account and any stored data will be revoked, and no refunds will be provided.

Article 6: Compliance with Laws

6.1 Legal Compliance

You are responsible for complying with all applicable laws and regulations regarding email sending, including local spam laws, the CAN-SPAM Act, GDPR, and ePrivacy Directive in the European Union. Deploy Email acts solely as a service provider and is not responsible for any legal actions taken against you due to violations of these laws.

6.2 Third-Party Requests

If a third party or local authority requests information about your use of our Services, Deploy Email will comply with such requests in accordance with applicable laws.

Article 7: Intellectual Property – Access and Use Rights

7.1 Trademarks

The name "Deploy Email" and all related trademarks, logos, and service marks are the property of Deploy Email. You may not use any such marks without our express written consent.

7.2 Copyrights

All content on our website and within our Services is protected by copyright law and is the property of Deploy Email. You are granted a limited, non-exclusive, non-transferable right to access and use the Service, but this does not transfer any intellectual property rights to you.

Article 8: Subcontracting

8.1 Right to Subcontract

Deploy Email reserves the right to subcontract any part of the Services to third parties. We remain responsible for the performance of subcontracted services under these Terms.

Article 9: Support and Service Levels

9.1 Reasonable Efforts

Deploy Email shall use reasonable efforts to ensure that emails sent by you are properly routed to their recipients’ electronic mailboxes. We provide online monitoring services, enabling you to manage your email campaigns in real-time.

9.2 Support

You must appoint an Administrator to manage assistance requests from your users. Deploy Email will provide second-level support to address any unresolved issues.

Article 10: Domain Purchasing and Ownership

10.1 Domain Ownership

Deploy Email may purchase domains on your behalf, typically retaining ownership. However, these domains are considered your property, and we will transfer them to your Namecheap account upon request.

Article 11: Force Majeure

11.1 Force Majeure Events

Deploy Email shall not be liable for any failure or delay in performance due to circumstances beyond our control, including but not limited to acts of God, natural disasters, strikes, or disruptions in communication systems. In such events, our obligations will be suspended for the duration of the event.

Article 12: Your Data

12.1 Definition of Your Data

"Your Data" refers to any data and content stored or transmitted via the Services by or on behalf of you or your end-users. This may include data you import from third-party services, messages you send, files you upload, and any other content you enter or upload into Deploy Email's systems.

12.2 Data Rights and Usage

You retain full ownership of Your Data. Deploy Email does not claim any ownership rights over Your Data. However, by using our Services, you grant Deploy Email the necessary rights to transmit, store, and copy Your Data in order to display it to you, enable you to search it, create backups to prevent data loss, and improve our Services.

12.3 Third-Party Services

In order to use Deploy Email’s Services, you may need to link a third-party email account to your Deploy Email account. By doing so, you grant Deploy Email permission to access your email account for sending emails and checking for replies.

12.4 Responsibilities

You are solely responsible for the content of Your Data and for your conduct while using the Services. It is your responsibility to ensure that you have all necessary rights and permissions to comply with these Terms and avoid infringing on the rights of others.

12.5 Data Validation

Deploy Email may verify the validity of email addresses uploaded to your account to maintain high deliverability standards. Email addresses identified as invalid may be blocked by the system, preventing you from sending emails to those addresses.

12.6 Data Privacy and Monitoring

While Deploy Email strives to ensure the privacy of Your Data, we reserve the right to monitor data within our Services to comply with legal obligations, improve the Services, and prevent unlawful activities.

12.7 Warm-Up Process for Email Deliverability

To enhance the deliverability of your emails, Deploy Email utilizes a process known as "warm-up." This process involves sending emails on your behalf to controlled third-party email accounts that are under our management. These interactions simulate real email conversations, which helps to improve the reputation of your sending domain and ultimately enhances service performance and deliverability. By using our Services, you consent to this warm-up process as part of our efforts to improve email performance.
